Information for Parties
We have a passion for resolving disputes. Together we bring experience, knowledge and a genuine concern for all participants in conflict to the table. As lawyers with different backgrounds and professional and personal experiences, we bring unique perspectives to each mediation. Recognizing that conflict is about more than a rational assessment of rights and positions but also about a myriad of human reactions and emotions, we facilitate holistic, integrated decision making.

We strive to help parties relate to different perspectives, understand important dynamics, guide negotiations and create opportunities for settlement.

We handle a broad range of cases and specialize in working together in complex and multi-party cases. Our co-mediation approach that has proven highly effective in resolving claims and other conflicts. We have extensive experience and expertise in handling personal injury and catastrophic loss, medical malpractice, employment, commercial, construction, financial and bankruptcy and family matters. We handle complex cases involving multiple parties, class action cases and multi-million dollar claims. Our approach in mediation is to create a process where all participants are engaged in identifying issues, getting to the heart of the conflict and assessing priorities and risk. We individually assess multiple, opposing perspectives and collaborate on approaches to move toward creative solutions and resolution.  Together, in collaboration with the participants, we design a strategy to arrive at solutions that reflect the needs and desires of all participants.

Understanding how difficult it is to navigate the uncertain terrain of litigation, we believe the parties themselves are best equipped to make decisions about their case. Our mediation process provides a supportive environment for negotiation and resolution.

Believing that mediators are at their best when working from a platform of compassion and not judgment or detachment enables us to build trust and connect with people.  Our belief that establishing a rapport with parties in a genuine, engaged manner helps to reduce posturing and non-productive negotiations and helps create an environment that allows opposing viewpoints to be aired with candor and respect.
While we base our model on a platform of empathy and understanding we also ask the tough questions necessary to make all participants in the mediation realistically assess their positions and evaluate other perspectives and risk.

We recognize there are many different approaches to negotiation so we customize our process to the specific nature of the dispute, the styles of the participants and the dynamics of the conflict. To complement our experience in mediation, negotiation and resolving conflict we also believe it is important to understand the science of human behavior and decision making. We co-founded an educational institute, The Master Mediator Institute, to bring together leading scientists who study human behavior, neuroscience and decision making with mediators and executives. MMI is recognized by top advocates and leading mediators as a cutting edge effort in the study of human behavior, facilitated negotiation and decision science.

Confidentiality is a cornerstone of our practice so we do not list case details that may in any way identify specific parties or cases. Please call us if you would like references from attorneys regarding specific types of claims.

Each dispute is unique and therefore we take care to design the mediation process to reflect the needs of the parties, their experience and the substantive areas involved in the case.

Attorneys are asked to submit mediation briefs prior to the case so that we may study the issues and reflect upon the unique dynamics of each case.
